Jennifer D. Silverman, a member of the firm, is an intellectual property attorney who represents clients in the new media, technology, retail, manufacturing, e-commerce, marketing, advertising and fashion industries. Ms. Silverman’s clients are companies and individuals whose intellectual property is one of their most valuable assets. She collaborates with them to create strategies for implementing their business ideas in ways that foster growth yet minimize legal risk. She regularly speaks and publishes articles on intellectual property topics. See publications and presentations.
Her expertise includes protection of domestic and international trademarks, copyrights, trade dress, rights of publicity and privacy. Ms. Silverman frequently negotiates and prepares licensing and branding agreements, prepares notices and contracts for websites and e-commerce sites, and conducts due diligence in a variety of corporate transactions.
She regularly represents clients in adversarial situations including litigation before the US Trademark Trial and Appeal Board (TTAB), in federal or state court, or in connection with international disputes. She also has experience with proceedings under ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP) and under the Anticybersquatting Consumer Protection Act (ACPA). She is admitted to the bars of New York and New Jersey and to practice before the courts of the Southern & Eastern Districts of New York.
Prior to joining the Firm, Ms. Silverman was a partner at Pryor Cashman LLP. Ms. Silverman is an active member of the International Trademark Association (INTA), and is serving on the organization's Trademark Office Practices Committee, US Patent and Trademark Office Subcommittee (2010-2012). Prior to that, she was a member of INTA's Pacific/Canada TMO Relations Subcommittee (2007-2009). She also serves as the chair of a task force for UJA Federation New York.
Ms. Silverman has an AV® Peer Review Rating in the legal directory Martindale Hubbell, indicating that she attained the highest peer recognition rating for ethical standards and legal ability.
