Richard P. Kaye
Richard Kaye, a member of the Firm, specializes in state and federal court litigation, and acts as outside general counsel for numerous companies and in the representation of individuals in a wide range of business and real estate transactions. He has experience with all aspects of civil litigation and arbitration, from pre-trial proceedings through trial and appeals. He concentrates in corporate, commercial, real estate, contract, consumer credit, and construction matters, as well as employment law.
Mr. Kaye’s clients include companies and professional practices involved in technology, industrial, construction, retail and service businesses, as well as banks, real estate developers and brokerage firms, investment advisors, property owners, factors and condominium associations and cooperative corporations. He has extensive litigation experience in matters involving complex commercial transactions, business disputes, commercial and residential real estate matters, consumer credit claims under state and federal statutes (including the Fair Credit Reporting and Fair Debt Collection Practices Acts), and construction and mechanic’s lien matters. He also represents not-for-profit organizations active in the New York metropolitan area. He takes particular pride in close communications and long-standing relationships with his clients, and the achievement of good results both before and after trial.
A former Assistant District Attorney in Manhattan, Mr. Kaye is admitted to practice law before the courts of New York as well as the United States District Court for the Southern and Eastern Districts of New York and the United States Court of Appeals for the Second Circuit.
Mr. Kaye was a founding partner of Berger & Kaye LLP and, previously, a partner at several well known law firms in Manhattan. He is a member of the American and New York State Bar Associations and the Association of the Bar of the City of New York, and has been active in committee work relating to civil procedure and the judiciary. He serves on the Board of Directors of, and as counsel to, the Ronald McDonald House of the Greater Hudson Valley located at Maria Fareri Children's Hospital in Westchester County, New York and Arts & Minds, Inc. which offers art related programs for Alzheimer’s patients and their caregivers. Mr. Kaye is also a member of the Board of Directors of the White Plains Library Foundation.
In addition to acting as a “judge” in numerous Moot Court programs sponsored by the American Bar Association and various law schools, he is an active participant in Continuing Legal Education programs focusing on civil litigation topics. Mr. Kaye has been an instructor in civil litigation for the Marymount Manhattan College Paralegal Studies Program and has served as an attorney-arbitrator in the Small Claims Part of the Civil Court of the City of New York in Manhattan. Avenue Magazine, in conjunction with LexisNexis Martindale-Hubbell, has named Mr. Kaye one of the city's top litigation attorneys.
Mr. Kaye received a Juris Doctor degree from The George Washington University Law School in 1978, and received a Bachelor of Arts degree, magna cum laude, from Clark University, where he was elected to Phi Beta Kappa.
