Brian D. Polivy is an associate in the Firm’s Labor and Employment Practice Group. He has extensive experience in traditional labor matters, including representing clients in mediation and arbitration, and providing counseling regarding collective bargaining agreements. Mr. Polivy also has experience defending clients against claims of employment discrimination, harassment and retaliation in federal and state court, as well as before administrative agencies.
Mr. Polivy counsels employers of all sizes on workplace issues such as proper pay practice, employee classification, discipline, termination, accommodation and leave. He also drafts employment policies and agreements and assists employers with updating employee handbooks.
Prior to joining Ellenoff Grossman & Schloe LLP, Mr. Polivy was a Labor and Employment associate at another New York City law firm. He had previously served as Assistant Corporation Counsel in the Labor and Employment Division of the New York City Law Department, where he defended the City of New York and its agencies in complex labor and employment matters in federal and state court. Brian also served as the Associate General Counsel for the NBA Coaches Association.
Mr. Polivy received his Bachelor of Science from Cornell University’s School of Industrial and Labor Relations and his Juris Doctor from the Benjamin N. Cardozo School of Law. Mr. Polivy is admitted to practice in New York, and the United States District Courts for the Southern and Eastern Districts of New York.
